PARTNER JIM SHERRY ARGUES BEFORE THE TEXAS SUPREME COURT

It is an exceptional honor to appear before the Texas Supreme Court, and on October 8th, McCathern, Shokouhi, Evans Partner Jim Sherry had that privilege. Representing both his client and our firm with distinction, Jim argued before the highest court in Texas — a milestone moment in the career of any appellate attorney.

Jim appeared on behalf of Platinum Construction, a McCathern client that previously secured a jury verdict in Rockwall County against Copper Creek Distributors for labor theft. The original trial team — Partners Ty M. Sheaks and Scott J. Becker, along with co-counsel Brandon Tittle — obtained a favorable verdict for Platinum. However, the Fifth Court of Appeals in Dallas later overturned that verdict, finding that the jury had been erroneously instructed regarding the defendant’s destruction of evidence.

After multiple rounds of briefing, Jim successfully persuaded the Texas Supreme Court to hear the case. His argument before the full Court represents a pivotal moment, as the forthcoming decision is expected to be the Court’s first major opinion on evidentiary spoliation since its landmark ruling in Brookshire Brothers Ltd. v. Aldridge more than a decade ago.
